Reserves
Reserves at Madigan Library are part of Circulation Services and encompass both traditional reserves and electronic reserves. Reserves are limited to those permitted under Copyright Law.
Traditional Reserves
These are physical hard-copy materials placed on reserve by instructors which can be accessed only by Penn College students, faculty, and staff at the Main Circulation Desk in the Madigan Library. Items in traditional reserves include books, paper copies, videos, cassette tapes, DVDs, CD-ROMs, maps, slides, software, equipment, and laptops. These are located at the Circulation Desk and may be borrowed for two hours, overnight, two days, three days, or one week, depending on the material. Materials put on reserve by an instructor may be located by the instructor's name or course code. Two-hour items do not leave the library. Reserve materials may not be renewed. Fines are assessed at $1.00 a day, per item, and include such items as study room keys and laptop accessories.
Electronic Reserves (Eres)
Electronic Reserves are course resources that can be viewed online; included are items such as scanned book pages, images, URLs, PowerPoint presentations, and test results which can be viewed, downloaded, or printed. Access to electronic material will be limited to the students and faculty of a particular course. The password will be provided by your instructor for the course; these passwords will not be kept on file in the library and once given are the student's responsibility. Processing of reserve materials can take several days. If you experience problems with Electronic Reserves, or cannot find material online which you think should be there, please go to the Main Circulation Desk at the Library, or call (570) 320-2400, ext. 7815.
Copyright Law
Based on copyright law and copyright guidelines, we have interpreted "fair use" to mean that we can use limited amounts of most copyrighted material one time without permission. Requests will be analyzed on a case by case basis to consider all factors in determining fair use. If the material is to be used for consecutive semesters, copyright permission is needed. The Library will assume the cost of copyright fees. All copyrighted material will require full citation information for processing for reserves. Copyrighted material placed on reserve must contain a copyright notice regarding further copying. In cases where copyright permission is not available, or fees are exorbitant, alternatives will be offered to the instructor whenever possible. In addition, access to copyrighted material is restricted by providing password protection for electronic reserve material. Materials will be made available in both print format and electronically in accordance with current copyright laws.
The Library relies on Title 17 of the United States Code, Copyright Law, Chapters 1 through 13. Fair use, as defined in Chapter 1, Section 107, considers the following four factors in determining fair use:
- The purpose and character of the work
- The nature of the copyrighted work
- The amount and substantiality of the portion used in relation to the copyrighted work as a whole
- The effect of the use upon the potential market of the copyrighted work
The Library will take all steps deemed necessary to ensure that materials placed on electronic and print reserve comply with copyright law. The Library will continue to examine the current interpretations of the copyright law and will make changes in its policies if necessary.
